These Terms of Service (the “Terms”) govern access to and use of titantechhq.com and any related website, content, inquiry form, client-facing feature, digital product, or service expressly made subject to these Terms (collectively, the “Site”). The Site is operated by Greenhost Networks, LLC, doing business as Titan Tech (“Titan Tech,” “we,” “us,” or “our”).
By accessing or using the Site, submitting an inquiry, purchasing a digital product, or using any service made subject to these Terms, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or services.
1. Scope of Our Services
Titan Tech provides technology services that may include website hosting, managed infrastructure, engineering and software development for hire, Magento / Adobe Commerce development, Shopify development, performance optimization, website diagnostics and platform audits, cloud and infrastructure consulting, maintenance and support, security remediation, application development, software modules, apps, and downloadable digital products.
Information on the Site describes our capabilities and is not a binding offer, scope of work, service-level commitment, warranty, or price quote unless expressly stated in a separate written agreement signed or accepted by Titan Tech.
2. Separate Agreements Control
Specific services may be governed by a proposal, master services agreement, statement of work, hosting agreement, data processing addendum, invoice terms, order form, product license, or other written agreement between you and Titan Tech (each, a “Service Agreement”). If these Terms conflict with a Service Agreement, the Service Agreement controls for the applicable service or transaction.
3. Eligibility and Business Use
You may use the Site only if you are legally able to enter into a binding contract. If you use the Site or request services on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.
4. Inquiries, Accounts and Credentials
You agree to provide accurate and current information when contacting us, requesting services, creating an account, or completing any transaction. You are responsible for safeguarding credentials, authentication methods, API keys, administrative access, and other access information provided to you or used with your systems.
You must notify us promptly at [email protected] if you reasonably believe access credentials connected with Titan Tech services have been lost, compromised, or used without authorization.
5. Fees, Billing and Payment
Unless a Service Agreement states otherwise, fees are due as stated in the applicable proposal, invoice, checkout process, or product page. Titan Tech uses third-party invoicing and payment processing services to administer invoices and accept payments.
You are responsible for applicable charges, taxes, payment processing failures, chargebacks, collection costs, and fees identified in your Service Agreement or invoice, to the extent permitted by law.
6. No Refunds
Except where required by applicable law or expressly stated in a Service Agreement or product page, payments to Titan Tech are non-refundable. Time reserved, diagnostic work performed, hosting capacity made available, development services rendered, consulting services performed, and digital products delivered are not refundable.
7. Hosting and Managed Infrastructure Services
Where Titan Tech provides hosting, server administration, database hosting, application hosting, backups, monitoring, maintenance, deployment assistance, or related infrastructure services, you acknowledge that hosting environments may be affected by maintenance, software defects, third-party platform interruptions, cyberattacks, network failures, upstream provider failures, compatibility issues, and events outside our reasonable control.
Unless expressly set forth in a signed Service Agreement, Titan Tech does not provide any guaranteed uptime percentage, service-level credit, recovery-time objective, recovery-point objective, or uninterrupted availability commitment.
8. Client Responsibility for Backups and Data Preservation
You are responsible for maintaining current, independent, restorable backups of all websites, databases, files, source code, credentials, configurations, content, and other data associated with your business or systems.
Titan Tech may create, maintain, restore, or transmit backups as part of hosting, maintenance, migration, diagnostic, or support services. Unless a signed Service Agreement expressly provides otherwise, any backup maintained within a hosting platform or related service is operational in nature only and is not a substitute for your own independently preserved backup or disaster recovery plan. Titan Tech is not responsible for downloading, transferring, archiving, or preserving your backup data in a separate safe location outside the applicable hosting platform.
9. Access to Client Systems and Data
To perform requested services, Titan Tech may require access to your hosting environment, servers, administrative panels, source code, repositories, databases, logs, analytics, credentials, third-party applications, customer data, or other information within your systems. You authorize that access to the extent reasonably necessary to provide, secure, investigate, maintain, repair, migrate, or improve requested services.
You represent that you have the authority to grant any access or provide any data made available to Titan Tech. You remain responsible for your privacy notices, customer consents, regulatory obligations, data retention requirements, and instructions regarding your data, unless a separate written agreement expressly allocates a specific responsibility to Titan Tech.
10. Acceptable Use of Hosting and Services
You may not use the Site, hosting, software, or services provided by Titan Tech to:
- violate any applicable law or regulation;
- host, transmit, distribute, or facilitate malware, ransomware, malicious scripts, phishing, credential theft, or unauthorized access;
- send unsolicited bulk email, spam, unlawful marketing communications, or abusive traffic;
- infringe or misappropriate intellectual property, privacy, publicity, confidentiality, or other rights;
- store or distribute unlawful, fraudulent, deceptive, abusive, or exploitative material;
- probe, scan, attack, interfere with, or bypass security controls of any system without authorization;
- consume excessive computing, storage, bandwidth, database, or network resources in a manner that threatens service stability or third-party providers; or
- engage in conduct that exposes Titan Tech, its infrastructure, its clients, or its vendors to unreasonable security, operational, legal, or reputational risk.
Titan Tech may investigate suspected violations and may restrict, quarantine, suspend, or terminate affected services where reasonably necessary to protect infrastructure, other customers, third-party providers, or the public.
11. Suspension, Termination and Data Deletion
Titan Tech may suspend services for nonpayment, material breach, unlawful use, security risk, resource abuse, interference with infrastructure, or violation of these Terms or a Service Agreement.
Following termination, Titan Tech may delete hosted content, databases, backups, credentials, logs, and related client data after 30 days, unless a separate written agreement provides otherwise or retention is required by law. You are responsible for exporting and independently preserving your data before termination or expiration of that period.
12. Professional Services; No Guaranteed Results
Titan Tech may provide engineering, consulting, diagnostic, optimization, audit, security remediation, and related professional services. Technology work involves judgment, testing, dependencies, and changing third-party systems. Unless expressly promised in a signed Service Agreement, Titan Tech does not warrant that services will eliminate all defects, vulnerabilities, downtime, performance issues, integration failures, compatibility problems, revenue loss, conversion issues, or business risk.
We do not guarantee search engine rankings, conversion rates, revenue increases, platform approval, third-party certification, uninterrupted commerce operations, or any particular business outcome.
13. Digital Products and Software Licenses
Titan Tech may offer downloadable software, modules, applications, code, templates, reports, diagnostic products, or other digital materials in the future. Unless a product page or signed agreement expressly provides otherwise:
- all digital product sales are final and non-refundable, except where required by law;
- purchase grants a limited, non-exclusive, non-transferable license to use the product for the stated permitted purpose;
- purchase does not transfer ownership of Titan Tech intellectual property;
- you may not redistribute, resell, sublicense, publicly post, share license keys, or disclose source code or downloadable materials to unauthorized parties; and
- maintenance, support, installation, customization, updates, upgrades, compatibility fixes, and future-version support are included only where expressly stated in writing.
14. Intellectual Property
The Site, its design, text, branding, graphics, documentation, analyses, tools, software, code, templates, workflows, methods, processes, and other materials made available by Titan Tech are owned by Titan Tech or its licensors and are protected by applicable intellectual property laws.
For custom development services, ownership and license rights are governed by the applicable Service Agreement. Unless a Service Agreement expressly states otherwise, and even where paid custom deliverables are transferred to a client, Titan Tech retains all rights in its pre-existing materials, reusable code, frameworks, modules, utilities, libraries, scripts, methods, processes, know-how, general skills, diagnostic techniques, and generalized improvements that do not disclose the client’s confidential information.
15. Client Materials and Permissions
You retain ownership of content, data, trademarks, code, credentials, and other materials you provide to Titan Tech (“Client Materials”). You grant Titan Tech a limited permission to access, host, copy, modify, transmit, process, display, and otherwise use Client Materials only as reasonably necessary to provide requested services, administer the relationship, protect systems, comply with law, or enforce applicable agreements.
Titan Tech will identify you as a client or describe your project in marketing materials, portfolio content, case studies, or public communications only with your prior written or verbal approval.
16. Third-Party Platforms and Services
Our services may rely on or interact with third-party platforms, hosting companies, cloud providers, domain registrars, software vendors, APIs, payment processors, eCommerce platforms, extensions, themes, analytics tools, security services, and other providers. Titan Tech does not control and is not responsible for changes, outages, policies, security incidents, pricing, compatibility, approval decisions, or failures attributable to third-party services.
17. Confidentiality
Confidentiality obligations applicable to client engagements are governed by any applicable Service Agreement or nondisclosure agreement. You should not transmit sensitive credentials or confidential information through an unapproved channel. Titan Tech may use reasonable secure methods to exchange credentials, access systems, and protect confidential project information.
18. Disclaimers
To the maximum extent permitted by applicable law, the Site, its content, digital products, and any services not subject to a separate express written warranty are provided “as is” and “as available.” Titan Tech disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, compatibility, and error-free operation.
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
19. Limitation of Liability
To the maximum extent permitted by applicable law, Titan Tech and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, goodwill, use, data, backups, security, or business interruption, arising out of or relating to the Site, products, or services, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, Titan Tech’s aggregate liability arising out of or relating to the Site, any product, or any service will not exceed the fees actually paid by you to Titan Tech for the applicable product or service during the ninety (90) days immediately preceding the event giving rise to the claim.
This limitation does not exclude liability that cannot lawfully be excluded or limited. A Service Agreement may provide different limitations for a particular engagement, in which case that agreement controls.
20. Indemnification
You agree to defend, indemnify, and hold harmless Titan Tech and its owners, officers, employees, contractors, affiliates, and providers from claims, damages, liabilities, losses, judgments, costs, and reasonable attorneys’ fees arising out of or relating to your Client Materials, your systems, your breach of these Terms, your unlawful or unauthorized conduct, your violation of third-party rights, or your misuse of the Site, products, hosting, or services.
21. Copyright and Infringement Concerns
Titan Tech respects intellectual property rights. Concerns regarding content hosted on or transmitted through services provided by Titan Tech may be sent to [email protected] with sufficient information to identify the allegedly infringing material and the basis for the complaint.
This section is a reporting channel only. It does not state or imply that Titan Tech has registered a designated agent under the Digital Millennium Copyright Act or elected any statutory safe-harbor procedure.
22. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect information in connection with the Site and services and is incorporated into these Terms by reference.
23. Force Majeure
Titan Tech will not be liable for delay, interruption, or failure to perform caused by events beyond its reasonable control, including natural disaster, fire, severe weather, war, terrorism, labor dispute, civil disturbance, epidemic, governmental action, utility interruption, network or telecommunications outage, cyberattack, denial-of-service attack, upstream provider failure, third-party platform outage, supply interruption, or similar event.
24. Governing Law and Venue
These Terms and any dispute arising from or relating to them, the Site, or services not governed by a separate controlling Service Agreement will be governed by the laws of the State of Utah, without regard to conflict-of-law principles. Subject to applicable law, the parties agree that the state and federal courts located in Salt Lake County, Utah will have exclusive jurisdiction and venue over such disputes, and each party consents to personal jurisdiction in those courts.
25. Changes to These Terms
We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Material changes will apply prospectively unless otherwise permitted by law or agreed in writing. Your continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms.
26. General Terms
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision. You may not assign these Terms without our written consent. Titan Tech may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or transfer of the applicable business. These Terms, together with the Privacy Policy and any applicable Service Agreement, constitute the applicable agreement concerning the subject matter addressed herein.
